《勞動(dong)法》第48條規(gui)(gui)定,國(guo)(guo)家實行(xing)最(zui)低(di)工資(zi)保(bao)障制(zhi)度,最(zui)低(di)工資(zi)的具體標(biao)準由省、自治區、直(zhi)轄市(shi)人民政府規(gui)(gui)定。原勞動(dong)保(bao)障部頒布《最(zui)低(di)工資(zi)規(gui)(gui)定》,明(ming)確最(zui)低(di)工資(zi)標(biao)準每兩年(nian)至少調(diao)整一次。《國(guo)(guo)務(wu)院批轉發改(gai)委等(deng)部門關于深化收(shou)入(ru)分(fen)配制(zhi)度改(gai)革的若干意(yi)見(jian)的通知》要求,根據經濟發展、物價變動(dong)等(deng)因素(su),適時調(diao)整最(zui)低(di)工資(zi)標(biao)準。
2019山東最低工資標準
根據(ju)山東省人民政府《關于公(gong)布全省最(zui)低(di)工資標準(zhun)的通知(zhi)》山東省決定從2018年(nian)6月(yue)1日起(qi)對全省各市(shi)最(zui)低(di)工資標準(zhun)調整如(ru)下(xia):
一、調整后(hou)的全省月最低(di)工資標準為(wei)1910元、1730元、1550元;小(xiao)時(shi)最低(di)工資標準為(wei)19.1元、17.3元、15.5元(各市(shi)最低(di)工資標準見附圖)。
二、月(yue)最低(di)工(gong)資標準(zhun)適(shi)用于全日(ri)制(zhi)就(jiu)業勞(lao)動(dong)者;小時最低(di)工(gong)資標準(zhun)適(shi)用于非(fei)全日(ri)制(zhi)就(jiu)業勞(lao)動(dong)者。
三、各(ge)地要加強(qiang)對(dui)《最(zui)(zui)低工(gong)資規定》(原勞(lao)動(dong)和社會保障部令第21號)和最(zui)(zui)低工(gong)資標(biao)準(zhun)的(de)宣傳,在當地主要媒(mei)體上公布最(zui)(zui)低工(gong)資標(biao)準(zhun),讓用(yong)人單位、勞(lao)動(dong)者和公眾廣為了解。要進一(yi)步加強(qiang)對(dui)用(yong)人單位執行(xing)最(zui)(zui)低工(gong)資標(biao)準(zhun)情況的(de)監督檢查(cha),依法(fa)查(cha)處(chu)違(wei)反《最(zui)(zui)低工(gong)資規定》的(de)行(xing)為,切實維護勞(lao)動(dong)者合法(fa)權益。
另:最低工資≠標準工資
值得(de)注意的(de)(de)(de)是,最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)標(biao)準(zhun)不(bu)包含延(yan)長工(gong)(gong)(gong)(gong)(gong)作時間工(gong)(gong)(gong)(gong)(gong)資(zi)(zi),中班、夜班、高(gao)溫、低(di)溫、井(jing)下、有毒有害(hai)等特殊工(gong)(gong)(gong)(gong)(gong)作環境、條(tiao)件下的(de)(de)(de)津(jin)貼,以及法律、法規(gui)和(he)國家規(gui)定(ding)的(de)(de)(de)勞動(dong)(dong)者福(fu)利待(dai)遇等。對勞動(dong)(dong)者包吃住屬于用(yong)(yong)人(ren)單(dan)位給予職工(gong)(gong)(gong)(gong)(gong)的(de)(de)(de)福(fu)利,用(yong)(yong)人(ren)單(dan)位不(bu)能將此計(ji)算在(zai)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)之內,更不(bu)能因此使支付的(de)(de)(de)貨幣工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)低(di)于最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)標(biao)準(zhun)。實行(xing)計(ji)件工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)制的(de)(de)(de)用(yong)(yong)人(ren)單(dan)位必須科學(xue)合(he)理(li)制定(ding)勞動(dong)(dong)定(ding)額(e),確(que)定(ding)基本計(ji)件單(dan)價和(he)超額(e)計(ji)件單(dan)價,勞動(dong)(dong)者提供正常勞動(dong)(dong)并按基本計(ji)件單(dan)價計(ji)算的(de)(de)(de)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi),不(bu)得(de)低(di)于最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)標(biao)準(zhun)。勞動(dong)(dong)者個人(ren)應當(dang)繳納的(de)(de)(de)社會保險費和(he)住房公積金包含在(zai)最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)標(biao)準(zhun)之內。
山東2018年企業工資指導線
山東省人民政府還發布了2018年企業工資指導線,其中增長上線為11%、基準線為7%、下線為3%。這是(shi)山東(dong)連續9年(nian)調(diao)整最低工資標準,連續20年(nian)發(fa)布企業(ye)工資指導(dao)線。
企(qi)(qi)(qi)(qi)業(ye)工(gong)(gong)資指(zhi)導線是(shi)企(qi)(qi)(qi)(qi)業(ye)與職工(gong)(gong)開展工(gong)(gong)資集體協(xie)商的重要基礎。企(qi)(qi)(qi)(qi)業(ye)薪酬調查數據顯示,山(shan)東(dong)省企(qi)(qi)(qi)(qi)業(ye)人工(gong)(gong)成(cheng)本(ben)(ben)在全(quan)國處于中(zhong)等偏下水平,2011—2016年山(shan)東(dong)省企(qi)(qi)(qi)(qi)業(ye)人工(gong)(gong)成(cheng)本(ben)(ben)占(zhan)總(zong)成(cheng)本(ben)(ben)比重為12.25%,其(qi)中(zhong)勞動報(bao)酬占(zhan)總(zong)成(cheng)本(ben)(ben)比重為8.5%,社會保險費(fei)用占(zhan)總(zong)成(cheng)本(ben)(ben)比重為1.9%,企(qi)(qi)(qi)(qi)業(ye)職工(gong)(gong)工(gong)(gong)資仍(reng)有一(yi)定的增長空間。
