出臺背景和實施時間:為了(le)保障(zhang)因工(gong)(gong)作遭受(shou)事故傷害或者患職(zhi)業病的職(zhi)工(gong)(gong)獲得醫療救治和(he)(he)經濟補(bu)償,促(cu)進(jin)工(gong)(gong)傷預(yu)防(fang)和(he)(he)職(zhi)業康復,分(fen)散用人單位的工(gong)(gong)傷風險,國務(wu)院制定了(le)《工(gong)(gong)傷保險條例》行(xing)(xing)政法規,自(zi)2004年1月(yue)1日起施行(xing)(xing),后于(yu)2010年12月(yue)進(jin)行(xing)(xing)修(xiu)訂再施行(xing)(xing)。
職工有下列情形之一的,應當認定為工傷:
(一)在工作時間和工作場(chang)所內,因工作原(yuan)因受到事故(gu)傷(shang)害的;
(二)工(gong)作(zuo)時間前(qian)后(hou)在工(gong)作(zuo)場所內,從事與工(gong)作(zuo)有關的預備性或者收尾性工(gong)作(zuo)受到事故傷害的;
(三(san))在(zai)工作(zuo)時間(jian)和工作(zuo)場(chang)所內(nei),因履行工作(zuo)職(zhi)責受(shou)到暴力等意外傷害(hai)的;
(四(si))患(huan)職業病的;
(五(wu))因工外出期間,由(you)于工作原(yuan)因受到傷害或者發(fa)生事故(gu)下落不明的(de);
(六)在上(shang)下班途中,受到非本人主要責任的交通事故或者城市軌道交通、客(ke)運輪渡、火車事故傷害的;
(七)法律、行政法規規定應當認定為工傷的其他情(qing)形。
職工有下列情形之一的,視同工傷:
(一)在工(gong)作時間(jian)和工(gong)作崗位,突(tu)發疾(ji)病死亡或者(zhe)在48小時之(zhi)內經搶救(jiu)無效死亡的;
(二(er))在(zai)搶(qiang)險救(jiu)災等維護國家(jia)利益、公共(gong)利益活(huo)動中(zhong)受到傷害(hai)的;
(三)職工原在軍隊(dui)服役,因戰、因公(gong)負傷致殘(can),已(yi)取得革命(ming)傷殘(can)軍人證,到用人單位后(hou)舊傷復發的。
職工發生工傷,經治療傷情相對穩定后存在殘疾、影響勞動能力的,應當進行勞動能力鑒定,其中勞動功能障礙分為十個傷殘等級,最重的為一級,最輕的為十級。
職(zhi)工(gong)因工(gong)致殘被鑒定為一級(ji)至十級(ji)傷殘的,由工(gong)傷保(bao)險基金(jin)支付一次性傷殘補(bu)助(zhu)金(jin),標準如下(xia):

本人工資:是指工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)因工(gong)(gong)(gong)(gong)(gong)(gong)作遭(zao)受事故傷(shang)害或者患(huan)職(zhi)業病前12個(ge)月(yue)平(ping)(ping)均(jun)月(yue)繳(jiao)費工(gong)(gong)(gong)(gong)(gong)(gong)資。本人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)資高(gao)于統(tong)籌地區職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)平(ping)(ping)均(jun)工(gong)(gong)(gong)(gong)(gong)(gong)資300%的,按照統(tong)籌地區職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)平(ping)(ping)均(jun)工(gong)(gong)(gong)(gong)(gong)(gong)資的300%計算;本人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)資低于統(tong)籌地區職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)平(ping)(ping)均(jun)工(gong)(gong)(gong)(gong)(gong)(gong)資60%的,按照統(tong)籌地區職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)平(ping)(ping)均(jun)工(gong)(gong)(gong)(gong)(gong)(gong)資的60%計算。
職工因工死亡(wang),其近(jin)親(qin)(qin)屬(shu)按規(gui)定(ding)從工傷保(bao)險(xian)基金(jin)領取喪葬補助(zhu)金(jin)、供養親(qin)(qin)屬(shu)撫恤金(jin)和一次(ci)性(xing)工亡(wang)補助(zhu)金(jin),標準如下(xia):
一次性工亡補助金:標準為上一年度全(quan)國城鎮居民人均可(ke)支(zhi)配收(shou)入的20倍(bei)。
公式:全國(guo)城鎮(zhen)居(ju)民人均可支配(pei)收入×20
喪葬補助金:喪葬(zang)補助金為6個月的統籌地區上年(nian)度(du)職(zhi)工月平均(jun)工資(zi)。
公式:當地上年度社平工資×6
供養親屬撫恤金:按照職工(gong)本人(ren)工(gong)資(zi)的一定(ding)比例發(fa)給由因(yin)工(gong)死亡(wang)職工(gong)生前提供主要生活(huo)來(lai)源、無(wu)勞(lao)動能力的親(qin)屬(shu)。具體(ti)標準為:配(pei)偶每(mei)(mei)月(yue)40%,其他親(qin)屬(shu)每(mei)(mei)人(ren)每(mei)(mei)月(yue)30%,孤寡老(lao)人(ren)或(huo)者孤兒每(mei)(mei)人(ren)每(mei)(mei)月(yue)在上述標準的基礎上增(zeng)加10%。核定(ding)的各(ge)供養親(qin)屬(shu)的撫恤金之和不應高于因(yin)工(gong)死亡(wang)職工(gong)生前的工(gong)資(zi)。
公式:
配(pei)偶:死者本(ben)人工資×40%(按月支付)
其他親屬:死(si)者本人工資×30%(每人每月)
孤(gu)寡(gua)老人或孤(gu)兒(er):上述標準的基礎上增加(jia)10%
初次核定時(shi)上(shang)述撫恤金之和應≤職工(gong)月工(gong)資(zi)(按月計算)
